Is auto dialer legal? Rules in India, the US and the UK
Is auto dialer legal? In most countries the tool itself is lawful, while consent, do-not-call registers and calling hours decide whether a given call is allowed. Calling CRM summarises three regulators below, as general information rather than legal advice.
- Tool vs the way it is used
- India, US and UK sources
- A checklist before you dial
Is auto dialer legal?
Usually yes: the software is lawful, but who you call, with what consent and at what hour is regulated. Calling CRM dials one ordinary call at a time.
- Robocalls and recorded messages face the strictest rules
- Respect do-not-call registers and people who opt out
- Check the regulator in every country you call
Is auto dialer legal: who, what and where to check
A short map of the three sources read for this guide. Rules change, so open the source before relying on it.
| Country | Rule in short | Source |
|---|---|---|
| India | Commercial calls are governed by the Telecom Commercial Communications Customer Preference Regulations, 2018 and their amendments, including customer preference (DND) registration | TRAI |
| United States | No autodialed or prerecorded calls to mobile numbers without prior express consent; telemarketing this way needs prior express written consent | 47 CFR 64.1200(a) |
| United States | No telephone solicitation before 8 a.m. or after 9 p.m. local time, or to numbers on the national do-not-call registry | 47 CFR 64.1200(c) |
| United States | Abandoned calls limited to three percent per 30-day campaign | 47 CFR 64.1200(a)(7) |
| United Kingdom | Live marketing calls must not go to TPS or CTPS numbers without specific consent, or to anyone who objected | ICO, PECR reg. 21 |
| United Kingdom | Automated marketing calls that play a recorded message need specific consent for that kind of call | ICO, PECR reg. 19 |
Is auto dialer legal in India?
TRAI, the telecom regulator, governs unsolicited commercial communication through the Telecom Commercial Communications Customer Preference Regulations, 2018, which have been amended since. These rules cover commercial calls and messages and the customer’s right to block categories of them through preference (DND) registration.
The regulator’s page lists the regulation and every amendment with its date. Read the current version there before planning promotional calling, because the rules on registration, headers and numbering have changed more than once.
Is auto dialer legal in the United States?
Federal rules in 47 CFR 64.1200 restrict calls made with an "automatic telephone dialing system or an artificial or prerecorded voice". Calls of that kind to mobile numbers need the called party’s prior express consent, and telemarketing calls of that kind need prior express written consent.
The same section bars telephone solicitation before 8 a.m. or after 9 p.m. at the called person’s location, requires honouring the national do-not-call registry, and caps abandoned calls at three percent of live-answered calls per 30-day campaign. States can add their own rules.
Is auto dialer legal in the United Kingdom?
The ICO explains the Privacy and Electronic Communications Regulations. For live marketing calls, a business must not call numbers registered with the Telephone Preference Service (or the Corporate TPS) unless the person has specifically agreed, and must not call anyone who has said they do not want the calls.
Automated marketing calls that play a recorded message are stricter: they need consent that specifically covers automated calls. In every case the caller must say who is calling and display a number the person can call back.
Is auto dialer legal for your team: a checklist
- Find out which countries your list covers and read each regulator’s current rules.
- Keep proof of how and when each person agreed to be called, where consent is required.
- Screen lists against the national do-not-call register where one exists.
- Keep your own do-not-call list of everyone who asks you to stop, and honour it at once.
- Ring within sensible local hours, and open every call by naming your company and the reason for ringing.
- Avoid recorded messages unless you hold the specific consent they require.
Is auto dialer legal with Calling CRM? How its dialer behaves
Calling CRM’s auto dialer places one ordinary call at a time from the SIM in the caller’s phone, and a person speaks on every call; it does not play prerecorded messages. Numbers can be added to an excluded list so they stay out of backup and all automation, and the block list keeps unwanted numbers in one place.
The software cannot judge consent for you. The checklist above, and your own legal advice, decide which numbers belong on a calling list. The difference between dialer types is explained in predictive dialer vs auto dialer.

Is auto dialer legal FAQ
Is an autodialer illegal?
Not by itself in the countries covered here. What can make a call unlawful is calling without required consent, ignoring do-not-call registers or calling at restricted hours.
Are power dialers illegal?
Power dialers are generally treated like other automatic dialing tools: the tool is allowed, but consent and do-not-call rules apply to the calls it makes.
Do I need consent to auto dial mobile numbers in the US?
Yes. US rules require prior express consent for autodialed calls to mobile numbers, and prior express written consent when those calls are telemarketing.
What hours can telemarketing calls be made in the US?
Between 8 a.m. and 9 p.m. at the called person’s local time, under 47 CFR 64.1200(c)(1).
What is the TPS in the UK?
The Telephone Preference Service is a central register of people who have opted out of live marketing calls. Businesses must screen against it unless the person specifically consented.
Which regulation covers commercial calls in India?
TRAI’s Telecom Commercial Communications Customer Preference Regulations, 2018, with later amendments. TRAI lists them on its unsolicited commercial communication page.
Does an auto dialer that calls one number at a time cause abandoned calls?
No. Abandoned calls come from dialing more numbers than there are people to answer them. A one-at-a-time dialer connects every answered call to the caller.
Is Calling CRM’s auto dialer a robocall tool?
No. Each call it starts is a normal mobile call from the user’s own SIM, placed singly, with a live person speaking. Calling CRM has no recorded-message feature.
What is the safest way to run an auto dialer campaign?
Call only people who agreed or who are lawfully callable, screen do-not-call lists, keep your own opt-out list and call at reasonable hours. Get local legal advice for your situation.
Do I need a separate do-not-call list?
Yes in practice. UK guidance says to keep your own list of people who object, and US rules also expect company-specific do-not-call lists.
Is this guide legal advice?
No. It is general information from the three regulators linked on this page, read on 23 October 2026. Check the current rules and take advice for your own case.
